The Court may order you out of your home and place a no-contact order on you, restricting your communication with the person you are accused of assaulting. Even if the person who has accused you of the assault tells the state prosecutor that they do not wish for you to be punished, you may find you are faced with prosecution through the statements of police officers or other witnesses.
An order of protection is an order restraining you from contacting or “coming about” a person that has accused you of wrongful conduct. If you are served with an order of protection, you need to immediately contact an attorney that can go to Court with you. A hearing will already be set on the order, and it will be in just a few days. Do not delay. And DO NOT contact the person who has initiated the order of protection. This order allows the police to come and arrest you for ANY contact that you have with that person, even before you have had a hearing.
