Conservatorship, Powers of Attorney, and Living Wills

When life becomes too difficult to manage, we need to have the confidence that our loved ones will lend a hand.

Family members who are unable to attend to their own welfare require someone to look out for their medical and financial affairs. The attorneys at LawCare  in Brentwood, Tennessee, are prepared to help families set up conservatorships, powers of attorney, and living wills to protect the interests of people who need day-to-day assistance in managing their affairs.

Helping People Protect their Interests

Whether our attorneys are helping people plan for the future or serving an immediate need, we understand that conservatorships, powers of attorney, and living wills are vitally important documents. We work closely with individuals and families to help sort out who is most capable of overseeing the needs of incapacitated people.

  • Conservatorship - A conservatorship is a legal relationship between two adults in which the court allows one to act for the benefit of the other. If a person is already incompetent, it is necessary to ask the court's permission to take on this role.
  • Living Will - These are documents that give one person the authority to make final life and death decisions should a parent or sibling be totally dependent on life-sustaining equipment. If there is not a living will in place, the hospital will present your parent or sibling with a "do not resuscitate" form. This means that the hospital personnel will have authority to make an immediate decision to not bring a person to life with artificial support systems.
  • Powers of Attorney - A power of attorney will allow you to make financial decisions, manage money, and sign documents for the benefit of another person without the necessity of asking the court’s permission.
  • Powers of Attorney for Healthcare - A power of attorney for healthcare will empower someone you trust to make your health care decisions when you cannot.  When faced with a terminal illness, catastrophic event, or long-term degeneration of your faculties, it is wise to have these instruments in place.

Our attorneys understand that relinquishing control over your affairs is a difficult and emotional decision. We work closely with you and, when appropriate, your family to ensure that your financial, life, and death decisions are in the hands of someone you know and trust.
